Clear rules and reliable services. The contractual conditions governing the relationship between WARE SRL and the Customer for the supply of digital products and cloud services.
These terms and conditions of supply govern the contractual relationship between WARE SRL, with registered office in Via Provinciale, 82 – 24021 Albino (BG), Italy, VAT ID / Tax Code: 04876650161, also referred to in this document as "Ware" or "Provider", and the Customer for the provision of digital products, hosting infrastructure, and related cloud services.
Basic Support: Includes support operations offered free of charge for active services. These consist of initial configuration, standard preferences setup, and minor troubleshooting interventions to assist the Customer in maintaining optimal operation.
Premium Support: Includes advanced operations of support, customized software optimization, complex repairs, development, or any dedicated billable technical intervention on the services offered.
Registration Authority (Registry): The body managing the registry of one or more Top-Level Domain (TLD) extensions (for example, the NIC Registry for .it domains or ICANN-accredited registries for gTLDs).
Best Effort: Indicates support provided with maximum technical commitment to complete an operation as swiftly as possible, without constituting an absolute guarantee of specific completion timeframes or specific outcomes beyond reasonable technical control.
Data: Digital content, information, databases, and files stored within the virtual or physical storage space allocated to the Customer.
Extensions & Software: Any software installed within the web space, including but not limited to CMS platforms (WordPress, Joomla), plugins, components, modules, themes, or custom frameworks.
MoR (Merchant of Record): The legal entity authorized for the sale of services to the end consumer, handling payment processing, international tax compliance, billing, and regulatory duties (such as Paddle.com for global transactions).
Mission Critical: High-priority systems and infrastructures requiring dedicated SLA, high availability architecture, and accelerated response times exceeding standard hosting parameters.
Parties: The Customer and WARE SRL.
Payment Processors: Available payment gateways. WARE SRL accepts payments via Bank Wire Transfer, Stripe, PayPal, and Merchant of Record (Paddle.com). Additional methods (such as Apple Pay, Google Pay, Satispay, Amazon Pay) may be enabled for specific services.
Quarantine: A designated virtual storage area where email messages marked as potentially dangerous, phishing, or spam are temporarily held before automated permanent deletion.
Paid Order: An order is marked as "paid" upon successful verification and settlement of the transaction through authorized payment channels.
Registrar: An organization accredited by the Registries to execute domain registration, DNS management, and renewal procedures.
Service: Any digital functionality, hosting plan, cloud server, domain, email account, or software provided as described on the official website.
Useful Time (Tempo Utile): The necessary technical timeframe required to process payment, verify transaction data, and provision or renew the service (typically 7 business days prior to expiration). Renewals submitted outside Useful Time cannot guarantee uninterrupted service availability.
WARE SRL operates through accredited national and international Registrars to register, administer, transfer, and renew domain names for the Customer. Domain registration requests are processed chronologically upon receipt of verified payment. Unpaid orders cannot be dispatched and are subject to automatic cancellation if payment is not settled within 7 days.
Successful registration is subject to approval by the competent Registrar and Registry for the selected extension. A domain displayed as available during checkout may become unavailable prior to actual Registry submission if a third party registers the name in the interim.
Domains are registered under the direct ownership of the Customer. The Customer is solely responsible for providing accurate, complete, and verifiable registration details.
Domain names remain active until contract expiration. WARE SRL sends automated expiration notices to the registered account email. It is the Customer's ongoing responsibility to maintain current contact details and ensure notification emails are not filtered into junk folders.
In the event a domain is not renewed within the Useful Time, the domain name and associated services are suspended and enter standardized Registry lifecycle states:

Each service has a duration corresponding to the selected billing period in the order form. Services provided by WARE SRL are not subject to tacit perpetual renewal without notice.
Customers utilizing recurring payment methods (Stripe / PayPal / Paddle) benefit from automated settlement, but remain responsible for verifying successful renewal execution and valid billing data.
Renewals are governed by the active price list and terms in force at the renewal date.
Customer Data Backup Responsibility: The Customer explicitly acknowledges that it is their exclusive responsibility to maintain independent off-site copies of all data, code, files, and databases processed through the Service. Upon contract termination or service cancellation, data stored on servers is permanently purged and unrecoverable.
If a domain is transferred to another provider prior to contract expiration, the Service is deemed concluded without right to pro-rata refunds.
Payment for services must be settled in full at order submission and in advance of service activation or renewal. Electronic invoices are issued in accordance with Italian and European fiscal regulations.
For Italian B2B customers, electronic invoices are transmitted through the Italian Revenue Agency SDI exchange system.
WARE SRL provides infrastructure with high standard availability across tier-IV European data centers. However, the Provider cannot be held liable for temporary interruptions caused by upstream network transit providers, force majeure, scheduled security maintenance, Distributed Denial of Service (DDoS) attacks beyond reasonable mitigation thresholds, or Customer software vulnerabilities.
The Customer is solely responsible for all content published, transmissions dispatched, and software scripts executed on their allocated server environment.

Submitting a technical support request constitutes explicit authorization for WARE SRL system engineers to access the hosting environment solely for diagnostics, repair, and service configuration.
Email services include enterprise antispam and antivirus scanning. The sending of unsolicited bulk email (SPAM), malicious attachments, or phishing communications is strictly prohibited and results in immediate service suspension.
Mailboxes exceeding storage quotas may be temporarily blocked from receiving new incoming messages until freed. Certified Electronic Mail (PEC) services comply with Italian digital administration standards (CAD) and require identity verification.
When third-party CMS applications (e.g. WordPress) or custom code are deployed, the Customer is obligated to apply timely security patches, updates, and secure passwords. WARE SRL reserves the right to isolate or disable compromised scripts (via CloudLinux CageFS / Imunify security filters) to prevent server-wide contagion.
Consumer Customers (private individuals not operating for commercial/professional purposes) have the right to withdraw from the contract within fourteen (14) days from the initial order date without penalty.
Legal Exclusions: Pursuant to consumer protection legislation, the right of withdrawal does not apply to customized services already fully provisioned, including domain name registrations and SSL certificates registered with official Authorities.
WARE SRL may employ advanced artificial intelligence algorithms for automated network monitoring, anomaly detection, DDoS defense, and support ticket triage. Such systems are deployed under strict human engineering oversight to safeguard performance and confidentiality.
Unauthorized scraping, systematic extraction, or automated exploitation of WARE SRL network resources without written consent is strictly prohibited.
WARE SRL operates and provides its authorized services exclusively through the following official domains:

These terms are governed by Italian law. For B2B commercial disputes, the Court of Bergamo (Italy) holds exclusive jurisdiction, subject to mandatory statutory consumer venues where applicable.
